DMC FINS TERMS AND CONDITIONS
The DMC FINS terms and conditions are valid for any goods or services provided by the Seller to the Client. The pricing, quantity of goods and time of delivery mentioned in the articles are not binding on the Seller, but the Seller will make all efforts to fulfill the stated estimates.
RETURNS & REFUNDS

We accept returns of unused and undamaged fins. Returns are usually as a result of incorrect sizing.

All feet are very different, so fitting a foot into a fixed shape foot cavity of moulded flexible material is an inexact science. We do not compare our fin sizes to shoe sizes as the construction of fins and shoes are very different.

Please note that each of our fin models has its own mould, so sizes may vary between models. Original training fin, Elite II and Repellor fins are a universal foot, meaning you can wear either fin on either foot, also giving you a wider foot cavity. Our Elite and Elite MAX are specific left and right foot fit. The sizing on our website is a 'Guide' only.

Customer satisfaction is extremely important to us. We will gladly accept returns for items purchased through dmcfins.com.au within 30 days of the original purchase date. 

Fins must be returned in a clean, saleable condition, with original tags and packaging, to be eligible for a refund. We suggest using tracking when sending your package.

To submit an item/s for return, first email the details of your return to orders2@dmcfins.com including your purchase information.

In the meantime, we recommend for a quick turnaround, you go back online and re-order the correct size. 

We do not pay for return shipping. We do not exchange.

We do not return Soft Surf Helmets, for hygiene reasons. Please check sizing carefully. Sizing instructions can be found on each SSH Model page.

Refunds

Only items purchased directly through dmcfins.com may be returned to our warehouse. Items purchased through our retail partners must be returned to the place of purchase and are subject to the return policies of the retail partner.

All accepted refunds follow the returns process detailed above and once approved are applied to the original card or method of purchase.

Please note that refund delays may occur as card issuer processing times vary greatly, something we are unable to influence.

We do not process exchanges.

We do not issue return labels.

Returns for Goggles cannot be accepted. For health and safety reasons once goggles are removed from packaging and the gasket is placed on the eye area - they are deemed to be used and cannot be returned.

Specials and discounted items - no returns for specials or discounted items will be accepted.

OUR PAYMENT TERMS & CONDITIONS
In regards to online shopping orders, the payment for such shall be paid in advance before the shipment. If any amount of the invoice is disputed by the Client, the Client shall inform the Seller of the grounds for such dispute within seven days of delivery of the goods and shall pay to the Seller the value of the invoice less the disputed amount in accordance with these payment terms. Where the Seller requires payment of a deposit, the Client acknowledges that the deposit is not returnable. All fees are exclusive of goods and service tax which will be added to invoices where appropriate. The Seller reserves the right to increase a quoted fee in the event that the client requests a variation to the work agreed.
THE TERMS & CONDITIONS OF DELIVERY

 

Shipping Times:

  • Orders usually take 1-4 business days to be delivered and we ship within 1-2 business days.
  • Shipping time might vary depending on location, shipment method and other factors.

Shipping Cost:

  • Orders will be charged for shipping depending on your order value.
  • Shipping over $99 is free for a limited time. (* Not available for Wholesale or Coach orders)
  • Full price will be displayed at checkout.

Shipping Promotion: 

  • Free shipping on orders of $99 and over from Friday October 25th, 2022 for a limited time.
  • Consumer orders only.

Delivery by the Seller will be deemed to have taken place when the materials are handed to the custody of the Client at his premises or to a deputed messenger or courier when posted. The Seller will be entitled to charge the Client for any expenses of delivery other than normal postage charges. The seller will always best attempt at matching the color-way ordered by the buyer but in the event of run-out or out of stock lines may from time to time ship the nearest matching.

WARRANTY OF GOODS
DMC Fins are warranted against manufacturing faults for 90 days from date of purchase. DMC fins are not warranted against misuse, or damage from sharp objects.

Care Instructions:
Always rinse in fresh water after use in salt water 
Keep out of direct sunlight for prolonged periods
Keep off hard surfaces
Avoid sharp objects like rocks or reef
We reserve the right to refund, replace or credit goods if deemed a result of faulty manufacture. For any claims, please refer to Returns and Refunds.
Goods purchased from a retailer must be returned to that point of purchase for refund or replacement, if deemed a warranty.

OUR CANCELLATION TERMS & CONDITIONS
In view of the nature of the service, any order - once confirmed by the Company - is not cancellable. Cancellation of the Order by the Client will only be accepted on condition that any costs, charges and expenses already incurred, including any charges that will be levied by the list-owner on account of his expenses, work or cancellation conditions will be reimbursed to the Company forthwith.
NOTICE LOSS OR DAMAGE TO GOODS The Company will take all reasonable steps to ensure the protection from loss, damage or destruction of the services or materials it supplies to the Client (or which may be received from the Client).
EMPLOYMENT OF PERSONNEL WARRANTY 
The Company warrants that it has the right to provide the Goods but otherwise the Goods are provided on an "as-is" basis without warranty of any kind, express or implied, oral or written including, without limitation, the implied conditions of merchantable quality, fitness for purpose and description, all of which are specifically and unreservedly excluded. In particular, but without limitation, no warranty is given that the Goods are suitable for the purposes intended by the Client. The Company warrants that the Goods will be supplied using reasonable care and skill. The Company does not warrant that the Goods supplied are error-free, accurate or complete.
LIMITATION OF LIABILITY
The Company shall not be liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in the Goods nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning or use of the Goods. Any liability of the Company shall in any event be limited to the license fees paid by the Client in the year in which the event of default arises. Nothing herein shall limit either party's liability for death or personal injury arising from the proven negligence by itself or its employees or agents. The Client shall fully indemnify the Company against any liability to third parties arising out of the Client's use of the Goods.
